Field Trip Waiver

FIELD TRIP: WEST SONOMA COAST 2026

ACKNOWLEDGEMENT, RELEASE, DISCHARGE AND INDEMNIFICATION

THIS ACKNOWLEDGEMENT, RELEASE, DISCHARGE AND INDEMNIFICATION (the “Release”), is made by the undersigned (the “Releasor”) in favor of Waveland Events LLC (“Waveland”), Timber Cove Resort, Hirsch Vineyards, Peay Vineyards, and Wayfarer Vineyard (collectively, the “Releasees”).

WHEREAS, the Releasor desires to participate in and/or attend the Field Trip: West Sonoma Coast camp experience, May 4-8, 2026, held in Sonoma County, California, including, without limitation, activities conducted at Timber Cove Resort, Hirsch Vineyards, Peay Vineyards,  Wayfarer Vineyard, foraging expeditions and social events hosted by Releasees (the “Premises”);

WHEREAS, the Releasor recognizes the dangers of, and assumes all risks of injury associated with, participating in the Field Trip: West Sonoma Coast camp experience; and 

WHEREAS, the Releasees are willing to allow Releasor to participate in and/or attend the Field Trip: West Sonoma Coast camp experience activities and social events held on the Premises subject to the terms and conditions of this Release.

NOW, THEREFORE, in consideration of being permitted to participate in and/or attend the Field Trip: West Sonoma Coast camp experience on the Premises, and intending to be legally bound, the Releasor, for him or herself or themselves and his or her or their heirs and assigns, hereby acknowledges, covenants, and agrees as follows:

1. The Releasor acknowledges and agrees that participating in or attending activities related to the Field Trip: West Sonoma Coast camp experience can be dangerous and may result in serious bodily injury or even death. The Releasor knowingly and freely assumes the risk of all injuries related to Releasor’s participation in the Field Trip: West Sonoma Coast camp experience. 
2. The Releasor hereby agrees that his/her/their participation in the Field Trip: West Sonoma Coast camp experience held on the Premises shall be deemed as an acknowledgement that the Premises are safe and suitable. If the Releasor observes any significant hazard during his/her/their presence or participation, he/she/they agree to bring such to the attention of the Waveland staff immediately.
3. The Releasor hereby agrees that he/she/they will conduct themselves in a safe and prudent manner and will exercise caution when participating in Field Trip: West Sonoma Coast camp experience activities and/or events held on the Premises.
4. The Releasor hereby waives, releases, discharges and covenants not to sue Releasees, together with the partners, members, officers, directors, employees, principals, affiliates, agents and sponsors of any of them from any and all claims, demands, causes of action, damages, liabilities, losses, costs and expenses (including attorney’s fees) suffered or incurred by the Releasor as a result of, or in any manner related to, directly or indirectly, his/her/their participation in the Field Trip: West Sonoma Coast camp experience activities or events.
5. The Releasor, and on behalf of his/her/their assigns, personal representatives and next of kin, hereby agrees to indemnify and hold each of the Releasees harmless from and against any and all claims, demands, causes of action, damages, liabilities, losses, costs and expenses (including attorney’s fees) suffered or incurred by the Releasee as a result of, or in any manner related to, directly or indirectly, the Releasor’s participation in the Field Trip: West Sonoma Coast camp experience activities or events EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others to the fullest extent permitted by law, and assume full responsibility for the Releasor’s participation.
6. The Releasor hereby authorizes Releasees to use in any manner his/her/their likeness while participating in the Field Trip: West Sonoma Coast camp experience activities or events on the Premises. The Releasor hereby disclaims any right to privacy related to the use of such likeness. The Releasor also hereby waives all claims, counterclaims, rights, demands, actions and causes of action, foreseen or unforeseen, actual or potential arising out of, or in any way related to, use by Releasees of such likenesses. The foregoing references to his/her/their likeness include all forms or reproductions of his/her/their image, voice or name, including, but not limited to video, audio or photo.
7. This Release shall be governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law provision or rule that would cause the application of the laws of any jurisdiction other than the State of New Jersey.

RELEASOR HAS READ AND FULLY UNDERSTANDS THIS ACKNOWLEDGEMENT, RELEASE, DISCHARGE AND INDEMNIFICATION. RELEASOR AGREES THAT NO REPRESENTATIONS, STATEMENTS OR INDUCEMENTS HAVE BEEN MADE TO ENCOURAGE HIM/HER/THEM TO ENTER INTO THIS RELEASE AND THAT HE/SHE/THEY IS DOING SO VOLUNTARILY.
